Meeting:        Salem Licensing Board held Monday September 14, 2009 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were Chairman Dave Shea, Members: John Casey and Rick Lee, Special Investigator, Lt. Ouellette and Melissa Pagliaro, Clerk.  
        
Approved:       Blanket Vendors License for various Haunted Happening events coordinated by Ellen Talkowsky.
        Ms. Talkowsky explained the various events and entertainment to the Board. She said she is requesting the License for events and entertainment to be held throughout downtown and on the Salem Common and Derby Square. She said that she will provide a list of vendors to the Board. She said the vendors would be CORI’d. She said that the Common events have already gone before the Park and Rec Commission as well.      
        Mr. Shea asked if Ms. Talkowsky would have a date for the entertainment in Derby Square before Halloween.
        Ms. Talkowsky said that she would.
        Mr. Lee motioned to approve

Discussion:     Ms. Talkowsky explained to Mr. Shea that Ms. Pagliaro has received two applications after the deadline and lottery dates for Halloween novelty vendors that we need to assign spaces to.
        Mr. Shea explained the process for the public gallery of how the Board holds a lottery for vendor applications. He said that Ms. Talkowsky and Ms. Pagliaro can work together on finding spaces for the remaining vendors.
                        
Approved:        Application for a Street Performers License. Present: Matthew Taranto.
                Mr. Shea asked if Mr. Taranto was here last year and his age.
                Mr. Taranto said that he was and that he is 14.
                Mr. Shea asked what Matthew does.
                Mr. Taranto said he will perform magic.
Mr. Shea asked if he remembered the rules and regulations and went over them with Matthew.
                Mr. Casey said the hours were from 10am-8pm 7 days a week.

Approved:       Application for Street Performers License. Present: Laurie Anslono
                Mr. Shea asked what she will be performing.
Ms. Anslono said that she is a mime artist. She said that she would like to bring a group of her students ages 14-17 in on the weekend of October 17 or 18 to perform.
Mr. Shea said working with a large group of Street Performers is a little bit different. He asked how many are in the group.
Ms. Anslono said that there are 14 in the group but she did not know if all 14 would attend.
Mr. Shea asked if she has done this before at Haunted Happenings.
Ms. Anslono said not here but she has had her groups at malls and other events.
Mr. Casey explained how they were allowed to collect tips.
Mr. Shea explained how crowded the pedestrian mall gets in October and asked Ms. Anslono be tactful and use good judgment when picking a space to stop with her group.
Ms. Anslono said that she would prefer to be out there during the daytime.
Mr. Shea said that is even better and asked what days.
Ms. Anslono said either the weekend of October 17 or the 24th.
Mr. Shea said she could do either or both if she wanted.

Approved:       Application for Street Performers License. Present: Judith Johnson.
Ms. Johnson said that she has been entertaining for 22 years and has done entertainment for the President of the Untied States.
Mr. Shea asked where she lived.
Ms. Johnson said she lives in New Hampshire but belongs to Some Salem organizations. She said she would like to do balloons, still works and face painting if she is allowed.  
Mr. Shea explained the area she could be in and told her it the hours were from 10am-8pm 7 days a week.
Mr. Lee motioned to approve
Mr. Casey seconded

Approved:       Application for Street Performers License. Present: Martha Jarnis for her son Evan Buso Jarnis who is away at College.
        Mr. Jarnis said that her son is away at College but has done this before downtown and wrote up something for her to give to the Board.
        Mr. Shea said that Mr. Buso does magic and there are no known issues with him.
        Mr. Casey motioned to approve

Approved:       One Day Liquor License. Applicant: St. John’s the Baptist. Present. Marilyn Costa.
        Mr. Casey asked about the event.
        Ms. Costa said that it is the annual Polish Picnic. She said that it is a family event with a lot of food.
        Mr. Shea asked if it was in the same location on St. Peters Street using the parking lot and basement as well. He also asked if she provided an insurance certificate and made arrangement s for a detail officer.
        Ms. Costa said that it will be the same as it always is.
        Mr. Casey motioned to approve

Approved:       8 (eight) One Day Liquor Licenses. Applicant: Hamilton Hall. Present: Tricia Schott.
        Mr. Shea said that Ms. Schott is before the Board to obtain eight one day liquor licenses for September and October.    
        Mr. Casey read the details of the eight events into the record and confirmed that Ms. Schott has a police detail and insurance for each event.
        Mr. Casey motioned to approve

Approved:       One Day Liquor License. Applicant: The Bowditch Institute. Present: Becky Putnam.
Mr. Casey read the application into the record and said that payment and insurance is still required.
Ms. Putnam said that the proceeds go to a scholarship for Salem student interested in the arts.
Mr. Shea said that Board would waive the fee.
Mr. Casey motioned to waive the fee and approve the application

No Show:        Application for two store sub-licensees for Fortunetelling. Applicant: Crow haven Corner.       

Approved:       Application for a C/V License at 28 Norman Street. Applicant: Bena Corp. d/b/a Georgia’s Pizza. Present: Violet Bena and assistant to Ms. Bena’s attorney.
        The assistant began by saying that this will replace DeLeo’s Pizza that was formerly at 28 Norman Street and will pretty much be run the same way.
        She said that Ms. Bena has been in the restaurant business for 10 years in a management position.  She said the BOH will be going in tomorrow for final inspections.
        Mr. Casey asked how many people for seating.
                Ms. Bena said there is a small counter and it only accommodates 6 seats.
Mr. Casey asked Ms. Bena to be conscious of keeping the store front swept and free of trash.
Mr. Shea asked about the hours of operation.
The assistant said that the hours would be Sunday thru Thursday 11am-10 pm and Friday and Saturday from 11am-11pm.
Mr. Shea asked when they planned on opening.
Ms. Bena said as soon as possible and told the Board she plans on doing a very good business with good food.

Discussion:     The Old Spot 121 Essex Street. Present: Milissa Oriabi, owner and Dave Gallagher, attorney.
Mr. Shea said that the Old Spot is present to go over the success or non success of scaling back the entertainment since July to work out issues with the upstairs homeowners.
Ms. Oriabi started by saying that the Board recommended that she and her husband (co-owner Brendan Crocker) try to settle the dispute with neighbors. She said that in July they agreed to play only acoustic music after 11pm on Monday nights, the only nights they currently have entertainment. She said it is a bit of a difference in music because it is not the same band make up now. She said she would like to go back to no restrictions on the current 7 day entertainment license that they hold. She said that they have tried everything possible to no avail.  She said she would like the Board to allow her back the 7 day license with no restrictions because of the fact that there is legal action pending in Superior Court. She said she is asking the Board to step back and let this be resolved by the Court. She said that she has a ruling from the Court stating she is allowed to use her 7 day entertainment license but is still only allowed Monday nights. She said that during all of this there was a period of 8 months when she had no entertainment at all.
Attorney Gallagher said that in the condo deed for the commercial space it allows music. He said he has a copy to provide the Board. He went on to describe how a complaint was sought by the condo owners and trustee, which are the developers. He also gave a copy of that to Mr. Shea. He said the judge determined there was not a likelihood of them winning a case. He is concerned that with the Boards input there will be conflicting orders. He said that currently the Court says one thing and the Board says another.
Amanda Lennon, owner of Unit #2, says that the only acoustic after 11pm on Mondays is only insignificantly better. She said they can kind of drown it out if they go upstairs. She said in the condo docs there is also a clause for quiet enjoyment.
Rob Ianuzzi, owner of Unit#2 as well, He said that on some Mondays since going acoustic after 11pm it has been better but other nights not.
Mr. Shea asked why it was better on some nights.
Ms. Oriabi said the Old Spot has purchased a piano that is now in the restaurant instead of having an electric keyboard. She said it may depend on outside noise and who is playing as well.
Mr. Grobecker, owner Unit#3 said that it is much more tolerable after 11pm with only acoustic.
Mr. Shea said that the Board has acted slowly on this issue because there are two partied that have issues because of another party. He said that the Old Spot has been terrific by restricting entertainment voluntarily. He said that the Board is also hearing from taxpaying citizens too. He said that based on the legal action that is pending the Board is going to not rescind any further entertainment or restore any either. He said at this time he is going to keep everything exactly as it is.

Hearing:        Murphy’s, 300 Derby Street. Present: Peter Kelly, owner and John Skerry, attorney.
Mr. Shea said that Mr. Kelly is here before the Board because of numerous complaints around closing time in regards to large crowds, fights, causing problems with traffic and issues with residents. He said that this is not was what envisioned when Murphy’s came before the Board with the business plan. He said this restaurant is growing to be ore of a nightclub and it is becoming a problem. He said that last year when there were very similar issues at another establishment downtown the Board took action and it helped. He noted that some action had been taken on behalf of Mr. Kelly since he was sent notice of this hearing. He would like Mr., Kelly to inform the Board of any changes that might change the Boards opinion at this time.
Attorney Skerry said that he would first like to address the issue of restaurant vs. nightclub. He said that Mr. Kelly started in the spring serving 150 to 200 meals a week. He said he is now serving up to 500 meals a week. He said it is the intent of the License holder to expand his restaurant business. He spoke of the “you tube” video. He said that the establishment employs about 39 people and that 14-16 of them are now posted outside at closing time to disperse the crowd peacefully. He said that all the people with black shirts in the video are employees outside. He said they dispersed the crowd in 4-5 minutes. He said that Mr. Kelly is working with the police, meeting with neighbors. He said that Derby Lofts named Darrell Sanders as a contact person. He said that Mr. Kelly does not desire ant troublemakers in his establishment. e sai Hre
 He said that Mr. Kelly is part of the “0 tolerance” program and they have already issued 4 no trespass orders, including one to the woman on the video. He said that Mr. Kelly has enforced a dress code, and is attempting to get everyone out of the building by 12:50 am. He said that Mr. Kelly is aware that they were under close scrutiny and being watched by the cameras that were up until just recently, on Derby Lofts. He said that Mr. Kelly is trying to work with the City. He said that of the other establishments that Mr. Kelly owns he has never had any problems like this. He said that Mr. Kelly is doing everything that the he can to minimize disruption and noise and he will continue to do so. He said that Mr. Kelly is open to any and all suggestions.
Mr. Kelly added that he has put restrictions on entry times and no new patrons are allowed in after 12. he said that downstairs closes at 12:30 and upstairs at 12:45 am. He said the one exit on Central Street was not working so he now opens both doors up at closing time.
Mr. Casey asked how long he has had the 14-16 employees outside at closing time.
Mr. Kelley said for about 4 weeks. He said initially it was 6-8 but it was not enough.
Shirley Walker, in the public gallery, resides at Derby Lofts said that residents thought that this meeting started at 7pm and are attending another meeting. She asked if the Board could wait for the others.
Mr. Shea noted the time to be six minutes of seven and said this would not wrap up that quickly.
Ms. Walker continued and said she would like to read from the Salem News article, in which she quoted herself. She also referred to the Mayor’s letter inviting resident s to this meeting tonight. She said that this has been a nightmare and also hopes that someone address’ the buck-a-beer issue.
Mr. Shea asked Mr. Kelly to talk about the Dollar a beer.
Mr. Kelly said that two weeks ago he changed it to $2 a beer.
Sgt. Rocheville of the Salem PD said that he sat down with Mr. Kelly two weeks ago. He said that Mr. Kelly informed him of the changes that he made, including the dress code, the added cover charge, the no gang materials, no doubling up, 2 drink limit at closing and changing the draft prices. He said that Mr. Kelly has made a lot of changes overt the past two weeks on his own. He also spoke about the cameras and said he spoke with Derby Lofts and told them that they were in violation of Section 272 CH9 the wiretap laws. He said the problems that have arisen in the B% zone are issues that the Board or the police are not used of yet. He said Mr. Kelly is part of the 0 tolerance initiative and wants to work with the community.  
Councilor McCarthy said that the attorney mentioned the amount of food being served. He said he would like to know how many kegs of beer are being served each week. He also said there is spilt occupancy in that building and he would like to know how Mr., Kelly is controlling the flow of patrons so that not all of the occupancy wends up in one spot.
Mr. Shea said that Mr. Kelly does not have to answer the question about kegs.
Mr. Kelly said he serves about 10-12 kegs of beer a week. He also said that they are using clickers on the inside to control occupancy in the separate areas.
Mr. Casey asked about the cover charge.
Mr. Kelly said the charge is $5.00
Amy Wood, from the public gallery, said she is a distributor for Merrimack Valley and Mr. Kelly has been her customer for 6 years starting with his business in Peabody. She said that establishment in Peabody was a mess and he cleaned it up and she feels he is doing the same here. She said he is an outstanding customer and he does everything by the book.
Mary Lynn Wulk, fro the public gallery, resides at Derby Lofts said she would like to have a comparison as to how much food compared to how much alcohol he serves. She also said that the distributor is someone making money off of Mr. Kelly not a neighbor. She said she has never seen a food delivery truck there.
Lt. Ouellette said comparisons should be in percentages.
Mr. Kelly said that right now it is 30% food and 70% alcohol but that the food percentage is getting larger.
Ted Solovikos, public gallery, resident of Salem, said that he recalls being at a meeting when Mr. Kelly was applying for the License. He said that there were people here complaining and opposing him then and he hadn’t even opened yet.
Terri Butler, public gallery, said that she is a resident of Salem and suggested that all of the servers in Murphy’s be TIPS certified. She said that if they were all TIPS certified that no one should be being over served.
Mr. Kelly said that all of the servers are TIPS certified.
Elaine Glickman, public gallery, resident of Derby Lofts said that when most residents bought their units the building that Murphy’s now occupies was empty. She said she is also interested in the ratios because she does not believe that food is served after 10pm, just alcohol.
Marlene Faust, public gallery, resident of Derby Lofts said that she thinks that last call must be around 12:30 am. She said that it is extremely noisy and they have had to see public urination, public sex, yelling and screaming. She said that the residents of Derby lofts were robbed of their entire summer.
Mr. Shea asked which nights are worst.
Ms. Faust said that Thursday, Friday and Saturday are the worse.
Mr. Shea asked what nights Mr. Kelly currently offers entertainment.
Mr. Kelly said that he has some form of entertainment on Tuesday, Wednesday, Thursday, Friday and Saturday.
William Perrone, public gallery, said that he’s a musician and has played in nearly every restaurant in this City. He said that music never creates chaos like sports. He asked the Board take a balance view of what they choose to suspend.
Mr. Shea said that there have been complaints since day one. He said he knows that a new establishment has to have growing pains and a get to know period.
Kevin Grady, public gallery, works for Derby Lofts and resides in Salem, said he has been on the roof of derby Lofts to observe the huge crowds. He said that Mr. Kelly has had 4 months to help the residents of Derby Lofts and has done nothing until he was called in for this Hearing.
Dan Faust, public gallery, resident of Derby Lofts said that he has not slept in four months. He said he is not trying to shut down the music but that it is out of control with patrons breaking windows and acting crazy. He said that Wednesday through Saturday he is woken at 1:30 am and he has to be up at 4:30 in the morning for work.
Kathy Paige, public gallery, resident of Derby Lofts, said that she lives over the bakery. She said that she has to keep her windows closed, the a/c on and use headphones at night. She said the noise is way too much. She said she supports the Salem business but this is out of control. She said where they are closer to the ground floor that the noise begins at 9pm.
Ms. Wood said that the people who bought homes downtown should have expected this. She said the noise is also from patrons of other bars downtown as well.
Ms. Walker stood up to announce that Mr. Sanders was present. She said that she sees the condition that the patrons are in exiting Murphy’s and they must be being over served because they are drunk. . She said patrons act crazy and are doing things like jumping in front of cars in traffic
Mr. Shea asked Ms. Walker what time the noise begins.
Ms. Walker said around 12:45am.
David Harting, public gallery, resides in Salem, said that he is 23 years old and a taxi driver. He said he sees the condition of patrons coming out of other bars in the area when he is called on a run and they are intoxicated too. He said that he has frequented most bars in the City and he thinks Murphy’s has the least problems.
Lt. Ouellette noted having gone to the establishment. He said he thinks that all sides are correct in some way. He said that with the help of lots of people from the City he think Mr. Kelly realizes that some things have to change. He said with the help of the Board and City officials he thinks this could all be worked out.
Sgt. Rocheville said that in response to someone’s questions about how many times police have been called to Murphy’s; they have been on 11 calls since April1st, 2009.
France Doris, public gallery, resident of Salem said that if the noise was to much that people could have chosen to live 3 or 4 blocks away from downtown.
Amy Aarons, public gallery, resident of Derby Lofts, said that she has lived there for 4 years and is expecting a baby. She said she lives on the 2nd floor facing the establishment. She said she expects typical noise but that the last three months have been horrible. She said it begins at 12:30 and goes on until 1:30 or 2 am. She said is affecting her sleep and it is hard to go to work and function.
Thomas Leach, public gallery, resident of Derby Lofts said that he is not against Mr. Kelly’s business. He said that eh frequents other establishments and they just are not as bad as Murphy’s. He said to hear people say that the noise issue is not a big deal is laughable.
Alicia Fairbank, public gallery, said that all she has heard is complaints and not any solutions. She said that Mr. Kelly goes above and beyond to try and fix problems.
Rinus Oosthoek, Exec Dir. Salem Chamber of Commerce, said that most restaurants in downtown Salem are working closely with the police. He said they have a started a fund to help with the police detail costs.
Mr. Sanders said that the issue of public safety is also a big concern.
Kevin Cirillo, public gallery, said that it is not a problem with the business. He said the problem is with the manner that Mr. Kelly chooses to operate. He said some temperament and tolerance would be great.
Councilor McCarthy asked how they accommodate smokers.
Mr. Kelly said they use the patio.
Councilor McCarthy aid if food is being served on the patio smokers should not be allowed there. He said that a task force is being formed and the issue of outdoor seating will be a topic.
Susan Ableton asked for clarification of the original presentation of Mr. Kelly’s business plan. She said she thought he said it was going to be family restaurant. She said her concerns are the use of space and safety.
Mr. Lee told Mr. Kelly that he feels like these changes have happened because the Board and the Police have been out. He said that when he first came forward with the application he told Mr. Kelly to take of business there otherwise this is exactly what would happen. He said that he and the Lt. have been there past last call and seen people going up stairs with a drink in each hand. He said the Board is tired of babysitting for his customers that have had to much to drink. He said there has been an occasion where every cruiser in the City had to be at that location. He said there is bad crowd coming from Murphy’s after 10pm. He said these residents have seen problem after problem and it has to stop. He said the Board made lots of suggestions and the police department is overwhelmed.
Mr. Casey said that this is the last time for issues like these. He said he has been on this board for a very long time and that bars disappear because of these types of problems and Murphy’s is no exception.
Councilor O’ Keefe asked if Murphy’s observed the 0 tolerance policy.
Mr. Shea said they do and have issued 4 no trespass orders.
Councilor O’ Keefe said he is also tired of hearing about the issues here. He said that the Board should keep Mr. Kelly close. He asked how much alcohol is being delivered.
Mr. Kelly said 11 to 12 kegs a week.
Mr. Casey asked if they also serve bottles.
Mr. Kelly said yes about 40-60 cases a week.
Councilor O’ Keefe suggested the Board not allow any entertainment on upcoming nights that have big sports events and possibly to close earlier.
Mr. Shea said closing time from 12:30 am seems to be the bigger problem. He said that he respects the changes that were made and they are all good things but there are still bigger issues here. He said again that these are almost identical problems to what another establishment had last year and the actions the Board took worked. He said that he would like in the form of a motion the following  proposed restrictions on entertainment: No live entertainment, DJ’s, jukebox, karaoke, trivia or outdoor entertainment after 10 pm on Thursday and Fridays and after 12 midnight on Saturday.
Mr. Lee motioned to approve the restrictions
Mr. Casey seconded

Mr. Shea said the board is trying to break the cycle and other establishments with issues like these had their full entertainment license back within three months when these restrictions helped with the problem. Mr. Shea said if this does not work the Board will restrict other nights.
Mr. Kelly said that he has functions that were previously booked.
Mr. Shea told him to submit to Ms. Pagliaro a list of what type of functions, the dates and how many on the guest list.
Mr. Kelly asked again if there was no entertainment on Thursdays.
Mr. Shea said there was but it had to end at 10 pm. He said if Mr. Kelly is interested in extending the hours which he serves food to let the Board know.

Discussion:     Jean Marie Val court. Applicant of a Class II Auto Dealer at 41 Boston Street.  
Mr. Shea said Mr., Val court was here previously but the Board requested more information. He asked Mr. Val court if he had a new lease.
Mr. Val court said he has a new lease and paperwork for a paving company he hired to restripe the lot.
Mr. Casey reviewed the paperwork and said the paving document does not show anything about striping.
Mr. Shea said a license will be conditional upon line striping. He said that before tonight Mr. Val courts paperwork was not complete but that he may now go forward with the legal advertising. He said Mr. Val court would be put on the Agenda for the next meeting. He told Mr. Val court to see Ms. Pagliaro for what he needed to advertise and notify.

Hearing:        2-4 Emerton Street Sober house. Present: Philip Malonson, owner
                Mr. Shea asked if he was the    owner of the building.
                Mr. Malonson said that he was.
Mr. Shea said the reason he was being called in is that it was brought to the LB attention that his building is not being operated in the manner in which it should be. He noted Building Commissioner Thomas St. Pierre that was present at the meeting and asked him to tell the LB what’s happened.
Mr. St. Pierre said that it was brought to the Building Departments attention through a Fire report. He said that a room on the third floor that was known to be the manager’s room now has a family with children staying there. He said there was also a stove installed in that unit.
Mr. Malonson introduced Misty Bodsworth and said that she is the tenant living in the unit. He said that she has really cleaned the place up. He said he believed that from zoning records he has 8 efficiency apartments on the 1st and 2nd floor and a 1 room apartment. He said that space has been empty since April. He said that he is trying to help Ms. Bosworth out and she has two children that are 14 & 16 years old.  He said the night of the incident with the stove when fire was called she had a 5 & 7 year old visiting the apartment. He said one of the children turned on the oven with the paperwork for the new stove in it. He said Ms. Bodsworth was in a previous bad situation and that he was trying to help her out with a place with reduced rent and he was not aware that he was doing anything wrong.
Lt. Griffin from Salem Fore Department said that she has yet to receive paperwork on the sprinklers of fire alarms from Mr. Malonson.
Mr. Malonson said he has faxed them and sad he would fax them to het again.
Mr. Shea asked him to also fax a copy to Ms. Pagliaro as well.
Lt. Griffin said that is was a surprise to the Fire Department to know that children were in a sober house and said there were 4 or 5 kids in there at the time of the alarm. She said she thinks there may be regulations about having children in a sober house and that needs to be clarified. She said that only magnifies the issue of getting the appropriate paperwork in. She said a call may be handled differently if the Fire Department knows there are children involved.
Mr. Shea said he does not want to put a family on the street but the Board needs to some time to figure this out.
Mr. St. Pierre said that he I not aware of the third floor being a separate unit.
Mr. Malonson gave his cell phone number to Fire and LB.
Mr. Shea said that the Board will review this matter in 30 days.
Mr. Malonson said that Ms. Bodworth would like to consider this her permanent home.
Mr. Shea said that he thinks that might not be the situation but he is not going to go that far now until he figures this out.
Councilor Sosnowski asked if there was any state or local funding being provided to this home. He said he would like to keep communication open between himself and Mr. Malonson.

Discussion:     Diane Manahan from Pamplemousse regarding annual Harvest Fest.
Ms. Manahan said this is the third annual Fest. She said that usually it is held a t the gathering but she would like to move it to the Salem YMCA ballroom.
Mr. Shea asked what the event is.
Ms. Manahan said that it is a wine tasting for Pamplemousse.
Mr. Casey asked about the date of the event and entertainment.
Ms. Manahan said that the date id October 24 and there is only someone playing a guitar and no other entertainment.
Mr. Shea said the questions asked by Mr. Casey were very serious. He said he wants described in very intricate detail what the entertainment will be and a formal application and she can submit that to Ms. Pagliaro.
Hearing:        Pegasus Auto, Bridge Street, Present: Charles Kopolous
Mr. Shea said Lt. Ouellette and Mr. Casey went on inspections and there  were some issues.      
Mr. Casey said that he and the Lt. went on an inspection of the lot on July 22. He said that the lot looked like a junk yard. He said that these lots should look professional and clean. He said that contrary to what conditions the Board ordered when they granted the License, cars are still parked along side the building where they are not supposed to be.
Mr. Kopolous said the cars along the building are not his that they belong to the auto body shop in the back. He said the Property itself belongs to Greg Turpin and that he only has 10 cars on the lot.
Mr. Casey said he wants Mr. Kopolus to designate which vehicles are his by placing the year and the amount for sale on the windows.
Mr. Kopolous said it looks junky because of the surroundings.
Mr. Casey said it should look professional.
Mr. Shea asked how long it will take to clean up the lot.
Mr. Kopolus said it is done already and said that the area he keeps his cars in is swept and clean.
Mr. Shea said no action required.

Hearing:        ADM Auto, 142 Canal Street. Present: Euclides Lopez
Mr. Casey said a n inspection was done on July 16 by he and Lt. Ouellette. He said he spoke with Mr. Lopez’s son, Joel. He said there were a couple of issues. First that the maximum amount of cars allowed on the lot is 25. He said at that time there were 31 cars on the lot. He said that Joel told him and the Lt. that they use Sunset Auto around the corner for vehicle repairs. He said that when he and the Lt. went to Sunset Auto they said they did not repair the vehicles.
Mr. Lopez said that was misunderstanding.
Mr. Casey also said the lot was overgrown with weeds and that vehicles were not logged into the registry book.
Mr. Lopez said he has already cleaned up the lot and now has room for 40 cars.
Mr. Shea said he may come before the Board and request that in a few months once there has been some time with no problems.
Mr. Casey said in order to add cars he will also need new certified plot plan.
Mr. Shea said in a few months he can go through the formal application process and the Board will consider it and said no action is required at this time.

Application:    Blanket Vending License for Puppy Mill Awareness Day. Present: Natalie Femino.
Ms. Femino said the event is this Saturday September19 at the Common to raise awareness for a movement to end puppy mills. She said she will have three tables that will be animal related things. She said she has been before the Park and Rec commission.
Mr. Casey asked who will be vending.
Ms. Femino said a local author, Happy Dog directory and Living with Pets. She said it is from 1-5 pm on the common and 200-300 people are expected.
Mr. Shea said the fee is waived because the proceeds go to a non profit.
Mr. Lee motioned to approve 3 vendor applications on the common on September 19 from 1-5 pm.

Commun-
ications:       Mr. Shea and Board read and reviewed letters from ABCC regarding Your Neighborhood Market. Mr. Shea noted that they paid a fine in lieu of suspension. Also, Brisas del Caribe was called into a hearing at the ABCC. They have not yet paid a fine in lieu of suspension.
        A letter from Attorney Carr was also received regarding information at 315-317 Essex Street.
